Advocate Tembeka Ngcukaitobi SC is widely regarded as one of South Africa's most accomplished constitutional lawyers, legal scholars, and public intellectuals. Renowned for his expertise in constitutional law, public law, land reform, and human rights, he has established himself as a leading figure in the South African legal profession through his distinguished advocacy, scholarly contributions, and public service.
He graduated with a BProc degree and an LLB degree in 1999. During his student years, he demonstrated exceptional leadership qualities and served as President of the Student Representative Council in 1997. He subsequently advanced his academic qualifications by obtaining a Master of Laws degree from Rhodes University and a further LLM degree from the London School of Economics and Political Science.
Ngcukaitobi commenced his legal career at the Legal Aid Clinic in Mthatha and later worked at the Legal Resources Centre in Grahamstown. He subsequently served as a law clerk to former Chief Justice Arthur Chaskalson at the Constitutional Court of South Africa. Thereafter, he practiced as an attorney at Bowman Gilfillan before joining the Johannesburg Bar as an advocate in 2010. Through his outstanding legal expertise and advocacy, he was elevated to Senior Counsel status in 2020.
Throughout his career, Advocate Ngcukaitobi has held numerous prestigious leadership and governance positions, including Member of the Judicial Service Commission; part-time Member of the Competition Tribunal; Chairperson of the Council of iYunivesithi Walter Sisulu; Honorary Professor of Law at iYunivesithi Walter Sisulu; Acting Judge of the Labour Court, Land Claims Court, and High Court of South Africa; Member of South Africa's legal team before the International Court of Justice in the South Africa v Israel proceedings; and Acting Justice of the Constitutional Court of South Africa for the period June to November 2026.
